First Solar Shares Fall as Company Withdraws Patent Complaint at Trade Commission
Shares of First Solar (FSLR) declined 4.85% in Friday trading, changing hands at $203.10 after the thin-film solar module maker withdrew a patent case pending before the U.S. International Trade Commission (ITC). The company characterized the withdrawal as procedural rather than substantive.
The ITC, a federal agency that adjudicates trade-related disputes including patent infringement claims involving imported goods, had been the venue for the complaint. First Solar, which manufactures photovoltaic (PV) modules using thin-film semiconductor technology across facilities in the United States, India, and other markets, said dropping the case does not signal a retreat from its intellectual-property enforcement efforts.
The move rippled across the solar sector. Enphase Energy (ENPH), which makes microinverters — semiconductor devices that convert the direct current produced by solar panels into household alternating current — fell 5.75% to $36.72, down from a prior close of $38.96. The company carries a market capitalization of roughly $5.16 billion.
Residential solar installer Sunrun (RUN) bucked the downward trend, rising 3.71% to $9.22 from a previous close of $8.89, giving the company a market cap of about $2.20 billion.
First Solar’s market capitalization stood at approximately $23.11 billion following the session’s decline, keeping it among the largest U.S.-listed solar technology companies by value.
Patent disputes at the ITC are common in the solar manufacturing space, where module technology and manufacturing processes are closely guarded. Companies often pursue parallel actions in district courts, so an ITC withdrawal does not necessarily end litigation between the parties involved.
Trading in the three names illustrates how sector news can affect companies differently depending on their business models: First Solar is primarily an upstream manufacturer selling modules to utility-scale project developers, Enphase sells components and home energy systems, and Sunrun operates in downstream residential installation and service.
