The move touches on one of the most contested technology disputes in the solar manufacturing sector.

TOPCon — tunnel oxide passivated contact — is a cell architecture that has become widely adopted across the crystalline silicon solar industry. First Solar, which is best known for its thin-film cadmium telluride modules, has asserted patent claims related to TOPCon in litigation against competitors. With the Section 232 process underway, the company is reshaping the scope and approach of its enforcement efforts rather than pursuing its claims as originally structured.

Intellectual property disputes carry outsized weight in solar manufacturing, where margins are thin and technology differentiation can determine which producers survive periods of module price declines.
