First Solar Pulls Its TOPCon Patent Complaint Before the US International Trade Commission

First Solar has withdrawn its patent complaint filed under Section 337 of US trade law with the US International Trade Commission (USITC), the company confirmed in a recent announcement. The complaint had targeted solar products built on TOPCon (tunnel oxide passivated contact) cell technology, a cell architecture now widely used across the solar manufacturing industry.

Section 337 cases allow companies to ask the USITC to block imports of products that allegedly infringe US intellectual property, an often faster and more sweeping remedy than standard district-court patent litigation. Withdrawing such a complaint removes the immediate threat of an import ban on TOPCon-based modules entering the US market, though it does not necessarily preclude First Solar from pursuing patent claims through other channels.

First Solar occupies a distinctive position in the industry: rather than making conventional crystalline-silicon modules, the company produces thin-film photovoltaic (PV) modules that convert sunlight to electricity using a cadmium telluride semiconductor layer. Patent disputes over TOPCon — a crystalline-silicon technology — therefore center on protecting IP positions around competing cell designs rather than on First Solar’s own core product line.

The move lands amid a volatile trading day for the company’s shares. First Solar stock traded at $203.10, down 4.85% from the previous close of $213.45, valuing the company at roughly $23.1 billion.

Context for the solar patent landscape

Intellectual-property contests have become a recurring feature of the solar manufacturing sector as cell technology transitions. TOPCon has emerged as the dominant next-generation crystalline-silicon platform, displacing older PERC designs across major manufacturing hubs. As margins compress in module production, manufacturers increasingly rely on patent portfolios to defend technology advantages — and Section 337 actions at the USITC have become a preferred tool because an exclusion order applies across an entire import category rather than against a single defendant.

A withdrawal can stem from many factors, including licensing discussions, settlement terms, or strategic reassessment of the litigation’s strength. The release did not detail the company’s rationale, and no ruling on the merits had been issued.
