First Solar Withdraws Patent Complaint at ITC, Keeps District Court Cases Alive Against Competitors

First Solar has moved to drop its patent infringement complaint before the U.S. International Trade Commission, according to a report carried by 1450 AM 99.7 FM WHTC. The thin-film solar module maker is not abandoning its broader intellectual property campaign, however — litigation against rival manufacturers continues in other forums, including federal district court.

The ITC, an independent federal agency, adjudicates trade disputes including claims that imported products infringe U.S. patents. Complaints there can result in exclusion orders blocking imports of infringing goods, a remedy particularly relevant in the solar sector, where much module manufacturing capacity is overseas. Withdrawing the ITC case narrows one avenue of enforcement but leaves the parallel lawsuits pending, which typically seek monetary damages rather than import bans.

Market reaction was negative on the session. Shares of First Solar traded at $203.10, down 4.85% from the prior close of $213.45, valuing the company at roughly $23.1 billion. The stock sits in the solar industry grouping within the broader technology sector.

First Solar manufactures photovoltaic modules using thin-film semiconductor technology, a distinct process from the crystalline silicon panels that dominate most of the global market. The company produces in the United States as well as in France, India, and Chile, and is among the largest domestic module manufacturers — a position that has drawn attention amid federal incentives encouraging U.S.-based solar supply chains.

Patent disputes among module makers have become a recurring feature of the industry as manufacturers compete on cell efficiency and proprietary designs. Outcomes in district court can take years, and the withdrawal of the ITC complaint does not resolve the underlying question of whether competitors’ products infringe First Solar’s intellectual property.
