First Solar Withdraws TOPCon Patent Complaint, Easing a solar IP Dispute

First Solar has moved to drop its patent complaint tied to TOPCon (tunnel oxide passivated contact) solar cell technology, according to a report by pv magazine Global. The complaint had been part of a broader wave of intellectual-property disputes rippling through the solar manufacturing industry as companies race to commercialize next-generation cell architectures.

The withdrawal means the specific claim will not proceed at this time, removing one point of legal friction in a sector where technology leadership — particularly around cell efficiency — has become a key competitive differentiator. TOPCon designs are widely viewed across the industry as an evolutionary step beyond PERC cells, offering higher conversion efficiency using manufacturing processes that many producers have already begun adopting.

For First Solar, the development arrives as the company’s shares trade under pressure. The stock was changing hands at $203.10, down 4.85% from the prior close of $213.45, valuing the Tempe, Arizona-based manufacturer at roughly $23.1 billion. First Solar is unusual among large module makers in that it focuses on thin-film cadmium telluride technology rather than the crystalline silicon platforms — including TOPCon — that dominate most of the market, and its intellectual-property position is a closely watched element of its business model.

Patent enforcement in solar has a long and consequential history. Past disputes over wafer, cell, and module technologies have reshaped supplier relationships, licensing arrangements, and manufacturing footprints across the global supply chain.
