First Solar Pulls Back from ITC Case, Redirects TOPCon Patent Dispute

First Solar has withdrawn its Section 337 case at the U.S. International Trade Commission, choosing instead to press its TOPCon patent claims through other legal channels, according to a report by digitimes. The move reshapes a legal fight centered on TOPCon — tunnel oxide passivated contact — a cell architecture widely adopted across the solar manufacturing industry as makers chase higher module efficiency.

Section 337 investigations allow patent holders to seek exclusion orders blocking imports of products that allegedly infringe U.S. intellectual property. Withdrawing the case does not necessarily end the underlying dispute; it signals that the company is concentrating its enforcement strategy elsewhere, likely in district court or other venues.

First Solar, which produces thin-film photovoltaic modules at U.S. facilities, has positioned itself as a domestic manufacturing champion amid competing patent activity across crystalline silicon technologies. TOPCon has become the dominant next-generation cell design for much of the global solar supply chain, making patent positions around the technology commercially significant.

The legal shift comes as the company’s stock has come under pressure. Shares of First Solar (FSLR) traded at $203.10, down 4.85% from the prior close of $213.45, giving the company a market capitalization of roughly $23.1 billion. The stock sits in the solar industry grouping within the broader technology sector.

Patent enforcement has become a recurring feature of the solar sector as manufacturers race to commercialize higher-efficiency cell designs. Companies have historically used both trade remedies and civil litigation to protect technology positions, and outcomes can influence licensing arrangements and supply relationships across the industry.

While the withdrawal removes one procedural front, the company retains its patent claims, and the dispute’s substance — who controls key TOPCon-related intellectual property — remains unresolved.
