BYD America has argued in a legal filing that First Solar is not the true owner of the solar technology patent at the center of an ongoing dispute between the two companies, according to a report from Bloomberg Law News.

The dispute centers on patent rights related to solar technology, an area where First Solar has built its business on thin-film photovoltaic (PV) modules — panels that use a semiconductor layer to convert sunlight into electricity, in contrast to the crystalline silicon approach used by most module makers. Ownership of foundational patents can be decisive in such cases, since a challenger who successfully questions who legitimately holds the rights can undermine claims of infringement before the underlying technology questions are even reached.
